Adoption finalized, but still not entered into the courts


What is the name of your state? KY

A step parent adoption was finalized April 16th. The CP's lawyer has yet to enter it into the courts for whatever reason. Is there a time limit of how long the lawyer has to enter it? Also, my husband's lawyer requested a copy of the adoption papers(finalization) and the CP's lawyer said that she didn't think she was allowed to give him a copy...is this correct? It seems as though my husband should get some type of final copy of the adoption.

Adoption records are permantly sealed. If your husband gave up a child for adoption, his rights were terminated and he has no rights to the adoption papers.

So my husband will not recieve some sort of paper showing that the adoption was in fact finalized? Do you know if there is a time limit on when the CP's lawyer has to enter it into the courts? We thought as of April 16th, it was finalized and that was that, but my husband's lawyer says that the CP's lawyer has yet to enter it into the courts. Does this mean it is not actually *final* yet? Unfortunately, his lawyer isn't spilling too much information or maybe he just has no clue...who knows.

All your husband needs to be concerned with is to make sure his parental rights were terminated. After that happens, he is 100% out with no rights toward the child, or any further court proceedings including the adoption decree.

I see what you mean by her DH not having the legal right to these papers to an extent.

However, my husband did a TPR and Consent, and an adoption almost 11 years ago with his child from his first marriage. And I can't tell you how many times he has has to provide a copy of his divorce papers, which triggers the need for a copy of the adoption papers (which he was provided with no problem from the attorney). Especially while he was in the Army and then when he transferred in his job from here to overseas.

Maybe it isn't the norm to receive a copy? LOL, of course a lot of things could have changed in 11 years.

I know it is a good thing he did receive a copy. The last time DH had to provide a copy of the Consent and the Final Adoption papers was just 4 months ago, and the Consent and Adoption was back in 1993. What triggers the need for the copy of the Adoption papers is his divorce papers from 1990, where it shows he is responsible for Ins and CS.

I wanted to add that there are some states that are open records when it comes to adoption, so that could be why TLWE's husband got papers on it.
