Adoption Question...Please Help!!


What is the name of your state? Maryland
We have had temporary custody in hopes of adoption of a beautiful baby. We have had this angel since birth the baby is now over 16 months old. The birth father has wavered several times in his decision. Saying he would sign over his rights, which he has never done. To saying he would do open adoption and to now saying he wants custody. I was just wondering ...what are his chances of getting full custody? He has known of the possibility of being the birth father since the birth mom's pregnancy. He was served adoption papers when the child was approx. 2 months old. He wrote in contesting the adoption. Since then he has done nothing to get this to court...- Dna was done and we were the ones that paid for the dna testing (our state law). So basically, its been us pushing for this adoption. He is the biological father...- He told us he will see us in court that was about 5 months ago. He has seen this baby once- No other contact or support was ever given to this angel. So basically he has had all this time to do something...and yet he still holds the key to our future. This angel is our whole world. We could not imagine a day without our angel!!! Please we are told the longer he does nothing the better..He found out he was the birthfather when the baby was 11 months old, but he knew the possibility of being the birthfather since the birth mom's pregnancy. I saw Maryland statue saying that consent is not needed if the child has been out of the parent's custody for one year...Would that apply to our situation? Please any info. or advice would be greatly appreciated...

A: 50-50, more or less.
