History: Google Hobbs/Van Stavern Lesbian Adoption Case. Hobbs had child and Van Stavern adopted it. When 5 yrs. old Hobbs finds a new love and breaks up the home and proceeds to withhold child. Van Stavern sues for visitation and Hobbs sues to have the adoption nullified. Van Stavern volunteered $400.00 per month support from the day she left the home. She also got temporary visitation orders every 2 months while the appeals went up through every court in Texas including the Texas Supreme Court and the adoption was upheld. 2 yrs. A jury then awarded Van Stavern Joint custody. Conservatorship. We are awaiting another appeal today. In Aug. Hobbs moved to MN. without notifying Van Stavern and without giving her a phone number or address. The child, now 8 told her it was MN. A contempt order was filed and Hobbs did not show last month. The judge was angry and ordered her attorneys to get her for another hearing this week. The punishment could have been up to 6 months in jail and/or all legal and court fees and a $500.00 fine and he told her that this week. She said Van Stavern had not exercised her rights to visitation. Van Stavern noted she did not know where they were. Van Stavern had documentation of being denied visitation before the move. The judge denied the contempt against Hobbs and did not even lecture her. I don't know yet if he will order me to pay her costs which she asked for! Question: What is going on here? Everytime we have gone to court I lose even though I have full joint custody and the standard 47% visitation that she denies me. What is my next move? I pay $700.00 per month plus medical. I make $34,000.00 as a policewoman and Hobbs makes $120,000.00 as a PHd. I feel like I am paying all her legal fees and she will not let me see or talk to our daughter. This just emboldened her! If I move to MN. she will be able to start all over again challenging the adoption so that is out. As it is, Texas retains jurisdition if I stay here. Me and my family can't afford to start at the beginning again. Please help!! Thanks. |
