What is the name of your state (only U.S. law)? South Dakota

I was wondering what I need to do- I would like to change my 4 year olds last name - I have gotton married and would like to change his last name to my married name. He currently has my maiden name, the bio father did sign the birth certificate. Can I easily change his last name?

Given that, according to your other thread, paternity has been established:

There is an child support order and paternity estaplished, but no court order for visitation or any kind of custody order
Dad will most certainly need to be served with your petition to change your child's name. Expect him to protest. Consider hyphenating your son's name.

Why is this being posted in the adoption forum?? Changing the childs name to your new husbands will NOT give hubby any rights to the child.
