changing my sons last name


My son is 18 and has not had any contact with his bio dad for 5 years.
He wants to change his last name to his step fathers, he and his girlfriend, who is 21, are going to have a baby. can they use the step fathers last name for the baby if it is born before my son can get his last name changed?What is the name of your state (only U.S. law)?
