Deadbeat Dad


my son's biological father refuses to give consent for my husband to adopt, bio dad owes me $3,500 back support, only sees son occasionally, and is not father material. (drug abuser) in nebraska what can i do to get around this and how much am i going to end up putting out in attorney fees?

Even if he only sees the child sporadically, and even if he is not as faithful about paying support as he should be, it's very difficult for you to get his parental rights terminated.

If he has gone more than a year without contacting the child and more than a year since he has paid support, you would have more of a chance. But if he does both sporadically, you're going to have a tough time forcing the issue.

He may agree to consent to the adoption, however, if he hears that future child support won't be collected. But he'll still be on the hook for the past support due.
