Different kind of stepparent adoption

What is the name of your state? CO

My husband wants to adopt my son from a previous relationship. The biological father said it was ok (so he can get out of paying child support, which rarely haoppens). But we are military in this state, and I get the child support through our state of residence which is GA according to the military. Do I have to apply for adoption there or can I file everything in the state of CO ? My ex doesn't even live in GA either, does that matter?

Please help !!! Thanks

Your husband can file in his current state of residence.
