I am currently working with a birth mother that is due in October. Upon reviewing my employers FMLA policy I discovered that, while I can take the 12 weeks for maternity leave I will not be allowed to use my sick time, only my vacation time. My employer states that I can only use my sick time if I physically have the child!! My employer only allows us to accrue 280 hours of vacation time (7 weeks) after that it rolls into my sick time. I have 460 hours of sick time saved. I feel that my employer is discriminating against me and that I should be allowed to use the time. If anyone knows of any laws, statutes or advice that would be useful to me in pursuing this matter I would really appreciate any help!!!
