Does Dad Still Have Rights?


We are located in California.

In March 2008 my husband signed a waiver of parental rights form for his daughter (5 years old) to be adopted by her step-father. (At the time, is was for the best interest of the child) If no action has been taken to terminate his rights and the adoption case has still not been opened, can my husband cancel the waiver he signed?? There are new signs of physical, mental and emotional abuse towards his daughter and my husband wishes to take every step necessary to protect her immediately.

The answer hasn't changed despite the duplicate post.

Your husband didn't call CPS even though his child is being abused. Why is that?

I'm sorry, I'm new to this site didn't know the post came up in multiple places, I thought I had to copy and paste it in the related areas.

We have never dealt with CPS before. We want to have all our ducks in a row before we make such a big move. Would calling CPS help? We don't want them knowing we were the ones who called for fear of our safety and his daughter's safety.
