He's Dead

What is the name of your state (only U.S. law)? Ny

My daughter is 10. Her father 1) was never officially her father, not birth cert or court order, nothing. and 2) is dead. Do I have to prove he was her father? do I have to prove he is dead for my husband to adopt my daughter?

My husband and I together 8 years. Daughters father was in and out, she knew her father but nothing serious. She is very upset over his death, and my husband wants to adopt her. We never persued it before, because of dad, but things have changed.

Can I just do this lawyer less?

I doubt dads family will have a problem. we have gotten along enough for daughter to spend time with them, but again, nothing serious.

Thank you.

i suggest consulting with an attorney. maybe hiring an attorney on a bundled services type of retainer. you do all the leg work and he over looks it, and you handle all the court hearings on your own.

i am sorry for your daughter's loss.
