I'm new hre, need quick advice... PLEASE !Ok, My name is Michelle, I have a son Logan who is 8 from a previous relationship, last year, his father sent me papers for my husband to adopt him, he had 90 days to change his mind and didn't, he was sent papers stating the date and time of the final hearing in case he wanted to contest, he didn't. now, a year later he wants to take me to court to reverse the adoption and get his rights back, and my Attorney says he has a good chance because judges feel sorry for natural parents. can someone shed some light on this for me, and is there anyone I can contact to get this rediculous law stopped? I'm frantic. Thank you. by the way, my childs name has been changed to his adopted fathers name and he has a new birth certificate? can this really happen??? |

i am missing something here..I have few questions: 1. Did the Adoption go through and how. Was it a default for a no show? or did he sign and send them in? Did his attoreny show cause ? i mean show why his client did not show up and contest the default? Were his rights terminated? If so there is no issue. 2. Has it been over a year ? How long to the day has it been since the adoption was finalized? 3. Ask your attorney about a abandonment issue with the dad doing no support or contact in that year. Shows that he has no concern for the child until now. Have the matter taken up with a different Judge thatn the one that is weak!!!!! Set it over as long as you need to to get another judge. Time is on your side. he longer he is without the child and papers drag you have the upper hand. Plus the 8 year old is still in a stable lifestyle. 4. First and foremost; research your states laws. The statutes will say what the state expects. Check out also, and this has nothing actually to do with your case, the Childrens Services Website for Georgia. They have alot of information on adoption requirements and termination proceedures. Your attorney could use some assistance so if you do the research he will appreciate it. Even though we pay them allot they are not super human and you can cut the cost of a legal assistant out of the picture. Most of all you know what is being said in COURT!!! |
