I live in North Carolina and my ex husband lives in Missouri. My ex husband has agreed to sign away his parental rights. My husband now is in the military. I would like to get an attorney in Missouri to take care of the paper work. Is that possible, or do I have to have it done in North Carolina?

In my case, my atty sent my ex the TPR and adoption papers through the mail, to Ks. The ex had them signed and notarized and sent them back, to my atty, in Mo. My atty submitted the paperwork, got a court date, and it was done within 6 wks.

If you have lived in NC for 6 months or more, then it has to be done here.

I'll tell you which forms you'll have to file and where to get them. All you need to do as far as the biological father is concerned is download the form for him to sign and either email it to him, show him where to download it, or mail it to him. Have him sign it in front of a notary, get it notarized and mail it back to you so you can file it with the petition that your husband will fill out.

This is what your husband will file.

You need to file all these things to the Clerk of Court in your county at the same time.


This is the adoption decree, which will be done after everything else... at the end of the process.

There may be other forms that you need up there as well, but those I know 100% are what you will need to get started. Take them to the Clerk of Court. You'll also have to pay filing fees.

Also, you're going to have to have a home study done by DSS. The process normally takes 3 to 6 months, depending on how stuff goes, although I've seen it take longer.. up to a year 1/2. That was because the attorneys screwed up the paperwork, didn't communicate and were lazy. It took 4 months to get the homestudy done by DSS.
