Looking Out For Baby

What is the name of your state? MO
MY SON AND HIS WIFE JUST HAD A BABY. HE DRINKS AND SMOKES MARIJUANA. SHE IS MENTALLY INCOMPETENT. THEY LIVE IN ARKANSAS WHILE I AM IN MISSOURI. WHICH STATE WOULD I HAVE TO FILE IN TO GET CUSTODY OF THE CHILD.:

You won't get custody.

Nothing stated by me should be taken as giving you legal advice or forming an attorney/client relationship. The devil is in the details after all.

The only thing you can do is to call CPS in Arkansas. Unless you are willing to move to thier state there's no way that you will get custody. As long as a family member is in the state, most CPS agencies will try to place a child with a family member, do you or your daughter-in-law have any family members in Arkansas? If so, speak to them about possibly taking temp custody if CPS removes the child from the home.

Also, typing in all caps is considered to be shouting, please don't shout.

Also -- the reasons OP gave for wanting custody were not necessarily reasons that would cause the parents to lose custody.

I'm afraid it's distinctly possible she was "diagnosed" by her FIL.

That's what I thought, too.
