Methods of adopting


I am interested in adopting my partner's son. I am unsure of the procedures in adoption. Does the biological father have to give up custody before I adopt the child?

Any advice or insight will be appreciated.

what state? either way you need to contact anyplace in your state that can tell you laws of your state? you may find some info at the courthouse.

His parental rights will terminated in the adoption process. What you can do is visit a law library in your area. Ask the desk clerk to assist you in finding the information you need. You can also (for a fee) copy the standard forms, fill out the information and file it with the courts yourself. Depending on your state (and age of the child), some require a home study be done before the adoption is final...or the judge will want to meet with all parties..it varies a little but nothing major. You'll have standard court fees and probably an additional one since a new birth certificate is requested (from the state where the child is born) Your brick wall is if the father doesn't want to terminate his rights....
