mom wants bio dad to terminate rightsWhat is the name of your state? Indiana My husband was previously married and had a child. He was ordered to pay a huge amount of child support for one child. His ex very soon remarried and quit her job because he new hubby makes probably twice as much as he did. My husband has never missed a payment! It in fact makes us struggle every month. We now have two children of our own. His daughter is now 11. His ex wants to see if my husband will terminate his rights so her husband can adopt his daughter. Make sense? My husband is unsure of what to do. He doesn't have a very good relationship with his daughter because mom (9 years later) is still filling her head with a bunch of garbage and doesn't let dad see her much. She is a problem child every time she does come and it causes chaos the entire time. Is this even possible to do? Does the child support stop at the time of adoption if my husband agrees to do this? It makes sense for his daughter not to have to go back and forth and have a stable household. |

| It's possible but a personal, not a legal decision.

| So BB, you are saying that the courts would grant this if all parties agree? Is it something that could be done without an attorney or would we have to pay for someone to handle this? Someone had told my husband before that he needs to think long and hard before agreeing to anything because they did that thinking that it would be in the child best interest as well. Turns out it was in mom & step-dad's best interest because even signing off rights and the child being adopted he still had support to pay. Not sure of the law in Indiana. |

The only possible monies that your husband would be responsible for are arrears. If he has never missed a payment, as you say, then there's nothing to worry about.

| Also the state of Indiana requires that a home study be done on mom's home, including criminal checks on mom and step-dad.
