Question

can stepdad adopt against realdad wishes


What is the name of your state?Tennessee
The last 2 times my 8 yr old daughter has visited her dad in NC, she comes back home asking where she would live if I (her mother) were to die. She has a two yr old sister and is about to have a baby brother. Her dad has not been stable with employment nor where he lives, I would like for my husband to gain custudy of the 8 yr old if I were to die. I know her father will not have that. Her dad would still have visitation rights- but what rights does her step-dad have? I want her to continue living with her step-dad and siblings. Waht if anything can I do now, while living, to ensure this?

Absent the bio father not being involved in the child's life AT ALL or being convicted of a crime in which qualifies for a termination of parental rights by your state if bio dad contests an adoption it will not go through

Step-parents have no legal rights and in the event of your death the child will go to live with her father absent anything legally showing him unfit. Then if that were to happen she would likely end up in the care of a blood relative that would take her in. The step-father would be last on the list prior to complete strangers. There is nothing you can do to prevent this absent an adoption and if bio will not consent that likely won't happen.
