His father and I lived together in Ohio until he was 6 months old. There has been no contact since then. He has never paid child support. I currently live in Michigan (I have for 7 years) and have been married for 3 years. My husband wants to adopt my son and we have no idea how to go about it. Where do we start? I have no idea where his father is. If my son was born in Ohio - do their laws apply? I'm very afraid of contacting him. Can he come into my sons life right now? Is there anything to protect us from that? Would he be forced to pay back child support if he wanted to come back (this would deter him - I'm not money hungry!) Any help is appreciated! |

| The first place to start, go see an attorney in Michigan. Your state laws there would apply, not the state in which the child was born. Do you have a court order for child support? Do you have a court order for visitation? If yes to a court order visitation, the bio father can come back into your childs life. If you have a court order for child support, then he will be responsible for any child support not paid up until now. The bio father has the right to due process, so he does need to be contacted regarding the termination of his rights. I would let an attorney handle that. If he is willing to sign over his rights, it should be pretty easy after that. If he will not consent, there are steps you must take...and then you must leave it in the hands of the judge.
