Question

name change/adoption

I live in Washington State. I have an 11 year old son. His bio father is in prison for murder. I married 9 1/2 years ago and my husband has been supporting and caring for my son. No contact from any of the bio's side. Can my husband adopt without bio's consent and if not can I change my son's last name?

If you lived in Indiana, your husband would be able to adopt the child without consent of the bio dad.

The laws may be different in your state, though I suspect they would allow for such an adoption there, too.

Consult an attorney in your state. Most offer free initial consultations.
