Question

Need help on final process of adoption


What is the name of your state? California

What forms do I need to terminate birth father's rights? How do I put an ad in the paper looking for the birth father when his whereabouts have been unknown since the birth mother was pregnant? This is a family adoption thru Social Services & they can not help with the termination of the birth father's rights. This adoption started in NC. Social Services in NC did try to notify the birth father but with no luck. We brought her home to CA when she was 8 days old. She is now 3 years old. We have been using Social services but when it came time to terminate parental rights, the birth father is where we are stuck. Social Services here did try by mail & thru department of transportation to contact the birth father but was unsuccessful. We are now at the point of not knowing what to do. Please help!

You would be best served by speaking with an attorney. Service by publication has some very specific requirements, and not following them could result in the adoption being voided at some point in the future. This is not a do-it-yourself project.

All the attorneys we contacted wanted retainer fees. We do not have $3000 to 5000 to put up. All we need to finish is terminating the rights. Can anyone just tell us what forms are need to file with the courts? This is a prenacy due to a rape. Do we still need to put an ad in the paper or can we just request the courts to terminate? If so, what forms are needed?

Was it reported as a rape at the time? Prosecuted? Obtain the police report.

If so, there is a very good chance of having the father's rights terminated.

The police department in this NC city told the parent that since the father was only 16 & the mother was 13 that rape charges could not be filed.

What now?

In order to put something in the paper you have to have already started the adoption. You do what you can to locate the father. Document everything. After you can not find the father you ask a judge for an order to place it in the paper. YOu cannot do this without an order from a judge. It is possible to do this without the bio fathers consent if he is not to be found. Don't give up. try this web site for more info [url]www.adoptions.com[/url].
