My son and his girlfriend and their children are child welfare involved. They have had two extensions and recently relapsed back into drugs. Their two children are currently in foster care with me. Because they are beyond their timeline, child wlefare can terminate their parental rights. Child welfare has not made a decision on how to proceed they are seeking legal counsel first. It looks as if parental rights will be terminated.
My son and his girlfriend have decided to relinquish their rights if child welfare decides to terminate their parental rights. They have heard that if they relinquish their rights that they and I assume guardianship of the children that they can go back to court at a later date and try to get their children back. Is there a law that allows this? If so, how long must they wait to pursue this avenue? What must they prove about themselves in order to get the children back? |
