We have been awarded permanent guardianship by the state of New Mexico, We live in Texas. This is my sister in-laws children she went to jail along with her common law spouse. He is still in jail and will be for a long time. She got out after three years and must serve two years parole, then probation. Both were convicted for child abuse and neglect. This is how we were awarded the children via court order permanent gaurdianship. The biological parents rights were not terminated, however visitation was not ordered. Part of her parole is that she can not have any contact with the children. Now we are wondering since she is out and grumbling about custody/visitation what we can do to keep the children with us and what if permanent guardianship pretty much protects us ? We belive that as the (new) parents of these children we will do whatever it takes to protect and keep them as the natural mother is not the best influence in their lives and should be kept away.
