We want to have our homestudy released from the agency we began our adoption process with. We have recently discovered they have a lawsuit against them and we want to sign a release and have our homestudy transfered to another agency. The new agency said to be prepared for a fight as they probably will not want to give it up. What are our legal rights in this instance? Our homestudy is paid for. We have not been working with any birthparents. What can the old agency do other than comply with our request if we wish to have it released? Thank you for your advice, Susan

If you paid for it then it is yours. Have the new adoption agency contact them with a fully signed release from you to obtain it if they will not give it to you.
