Step-Parent Adoption


What is the name of your state? FL

Hello...my husband would like to adopt my 5 year old son. We do not know how to go about doing this. Could you help?

A little history...my son was born in MA. When he was born the biological father never came to the hospital, I actually kicked him out of the house when I was 4 months pregnant. So, at the hospital when they asked me who the father was I said I did not know, so they left it blank on the birth certificate. I do know who the father is, I just did not want him to have any say in how my son was raised. This man has never had contact with my son and never will.

My husband has been the only father that my son has known since he was a llittle over a year old. We want him to share our last name (he currently has my maiden name) and always feel like he is a part of the family in whole. What do we do? Any help is greatly appreciated.

You petition in court. You MUST name the actual birthfather. You MUST establish that he is the biological father of the child. You MUST serve him with notice of the adoption and request for paternity and give him a chance to establish himself as the father and contest the adoption. Which he very well might. At which point the adoption will not succeed.
Oh and since you lied to the hospital regarding information placed on a LEGAL form, be prepared -- it is illegal to lie on official documents such as birth certificates.
You have a long process ahead of you.
