step parent adoption


i have a custody case with my sons bilogical father from ten years ago. i have not seen or heard from him since. my husband wants to adopt my son. what forms do i need to file with the court and do i just need to certify maill the papers to his last known address?

What did your original court orders address? Was he legally established as Dad?

And which state are you in?

original orders established physical custody to me with him having visitation. and joint legal. yes he was established as the father so he is what they call the presumed father. i live in san bernardino county, ca.

And he hasn't seen the child or paid CS for 10 years?

he has not seen or talked to my son in over ten years. the county recently (within the last year and a half) started garnishing his support of 131 a month because he owes them from when i was on medical and county aid tne years ago. thanks i will try out that website now.

In some states child support is considered "contact" and it may prevent from filing an abandonment case even if the parent hasn't seen the child in years.

I do want to check Florida's stance though.
