step-parent adoption without permission


What is the name of your state? ohio

i have been married to my husband 4 5 years and have been with him for 7 therefore he has been a father figure to my daughter since she was 18 months old. he has always wanted to adopt her, but the biological father will never sign over rights. he is a drug dealer and has 3 fellony drug convictions and just recently put a digital drug scale and her bratz box before she came home and forgot to take it out. needless to say the police have it now. but will not pursue in a crimianl manner or any other. so this has resparked the whole adoption thing for us. he has never willing paid child support. and will not work. he claims to be disabled and on ssi. the child support agency has terminated his support order in 2002. he still has 8000 of back to pay tho. so does the termination count as no support for one year. he has not kept up his end of the bargin with child support and has moved out of state they have tried to contact him to talk about the case, with no response and are pursuing it legally now. just want to know it his not cooperating and having been terminated counts. he is now opening a business.

Considering there is not a current support order the fact that he's not paying can not be used against him. You are best speaking to an attorney for a few consult but honestly I don't see legal ground to terminate and adopt without having to have his consent.

if hes collecting ssi the children are entitled to a portion of his check call social security

They are only entitled to money from Social Security IF he is getting SSDI. If he does not have enough work credits in SS, the children cannot get SSDI as his dependents. If he has always worked under the table, he likely has not accumulated enough credits to recieve SSDI

as disgusting as it sounds- dad may be more than willing to give up his rights if that 8K were going to go away too
