Sue the state

What is the name of your state: Indiana

I was sexually abused from ages 14 until 19 by the son of someone my juvenile records indicate as my legal guardian.

I just found out that these people did not have guardianship of me. I was in and out of the system for run away and then in the end for criminal charges. the court never checked to see if guardianship was in place or if the home was safe. I was even on probabtion. My high school transcripts list my mother as guardian and have a fake address listed as my address.

I do have DNA evidence of the abuse and one court record of pregnancy while I was 17. I was in the detention center for almost a year while pregnant and never received medical care and must have had a miscarriage because I did not have a the baby.

I was locked in a room for eight hours a day while the other youths attended school.

I was raped hundreds of times. Impregnanted numerous times before 18. Beaten up, spat upon, called horrible names. Exposed to drugs and crime.

Legal age to consent to to sex in IN is 16.

Can the state be held responsible for not contacting my parents and forcing me to go with these people?

i am reliving those five years and it is killing me.

I need some answers please.

You have already been advised (and very appropriately) to seek counseling; you may also want to speak with an attorney.

If legal action is possible it is more likely to be successful against the actual abuser than the State but either way you need to get yourself as healthy as you can be - that's your priority.

How is it they came to have custody? Did your family hand over custody? Where were your parents?

Also how did you become aware of the guardianship issue?

And could you please clarify this part?

And which part this is referring to:

I do have DNA evidence of the abuse and one court record of pregnancy while I was 17

i'm actually a little lost on the "must have had a miscarriage". if you KNEW you were pregnant, it's kind of hard to miss.

i really don't think the op has any standing to sue anyone except the assaulter at this point.

OP should have said something to SOMEONE. unfortunately, it's a hard lesson to learn.
