terminating fathers rights

i live in texas and my husband and i are trying to adopt two children who have lived with us for 2 1/2 years. They are now 4 and 5. The presumed father sits in prison. he is not on the birth certificate. The biological mother, grandmother, my husband and i went to court(2 years ago) to make my husband and i possessory conservators. The grandmother and her husband are joint managing conservators. They lived with there grandmother until ages 2 and 3 with little contact from presumed father. We want to continue and adopt what can we do?
