What is the name of your state? Illinois
My boyfriend and I have been together for the last 7 1/2 years. About 5 years ago he was awarded custody of his 2 children. Their natural mother had supervised visitation through an agency. She apparently chooses not to excersize her visitation rights. At the end of this month it will have been a year since she has seen her children. My question is; if my boyfriend dies what happens to the kids? Will I be able to raise them or is there a chance that the natural mother will take them from me? It seems to me that she has abandoned them but I can't be sure, because I do not know what the law is on abandonment. All I know is, it's been a year with no contact. Some people say that conact includes child support, but she has only sent a total over the last 5 years of $120.00. I do not consider that child support but does the law consider that child support? She was court ordered to pay child support and is now a little over $15,000.00 behind.
