Alimony and child support


What is the name of your state? I live in Oklahoma and my mother recently kicked my father out of the house for assaulting her child. Charges are still pending and she wants to get a divorce. She has very little money. They have been married 18 years and she has never worked in the marriage but has raised 5 children in which one still lives at home and is the one mentioned previously. He has consistently made between 75,000 and 100,000 dollars in the last 10 years. He is an independent contractor now and has never paid taxes, but he does have proof of income for the last two years. Can you please give me some advice on how much alimony she might get. She is desperate and he is avoiding his financial obligations. The child is 17 years old.

there are a couple of issues here.

1. how many children were born OF THE MARRIAGE?

2. did your mother ever work and/or what is she qualified to do?

He has been taking home $75-100,000 every year for the past 10 years and has NEVER paid taxes???????????????????????????????????????????????????????????????
The IRS are going to be all over him like a white girl on an NBA player

not necessarily. If I took home $200,000 I'd not have to pay a penny of taxes.

They have one child from their marriage. She is 49 years old. She has a highschool education and has only worked as a waitress brieflly. I am very surprised the IRS has not caught up with "Jack Ass". However, the IRS has sent him letters for the last two years showing the amount of money he has made and what he owes in back taxes. Do you have any idea of how much or an estimate of the amount of alimony he will have to pay. She is now 5,000 dollars behind on bills.

you are making some very broad assumptions. Alimony is not a gift awarded to the wife simply because she was married.
And the issue of the children is ONLY relevant to the child they had together.

From the slim details you posted, and the assumption that all or most of the children are out of the house, I doubt seriously if alimony will be awarded in this situation or, if it is, Rehabilitative in nature for a short time.

If she doesn't get to work soon, she'll be $10k behind.

Help her get a consult with a local attorney. She will honestly get better answers. The situation is complicated.

Not so complicated at all.

The husband works his butt off in the construction business and the wife fails to provide her share of sweat to pay the bills.

The wife enables the kid to be lazy just like her.

The husband has enough and gets tough on the kid. Wife doesn't like that and files for divorce.

The other kid now wants to know if she and the kids can still have access to the husbands money, knowing that it is easier to spend someone else's money than it is to work for your own.

The court will agree with the wife and award alimony because it's easier to take from the husband who has means than to tell the wife she is lazy and to get a job.

This is one of the reasons that responsible people are looking around themselves and saying "what the h@ll am I doing"??
