alimony modification chances


What is the name of your state? Ma

I was divorced Oct 2002. In August 2003 the ex moved to Georgia and lives with her boyfriend. I was ordered to pay 1000 a month alimony (lifetime order), however with key word "merge" to modify in the event of circumstances. I know in Ma, cohabitation alone does not constitute a modification, but let me say this. The ex does not use her spousal support to support her living in Ga, she uses it to pay the Mortgage on her house in Ma. To simplify things, she requests that i deposit the money in her checking acct, and she pays the mortgage online from Ga. Personnally, i have not handed her an alimony check for her own living expenses since Aug 2003. What do you think my chances are. And thanks in advance

Slim to none.

You can always return to court and ask that the permanent alimony be changed to "Rehabilitative Alimony" for a period of 4 years so that your ex can re-enter the workforce.

As it stands now, she can do with what she wants with the money. That part is none of your business. She will also never get married again since you're paying for her to have a nice home with boyfriend.

Don't hold out much hope however. The time to act would have been DURING the divorce.
