Both living off Community property

California -

I have not received any income since 2006. I have been living off savings and supporting myself and 3 kids from those savings since then. Since we legally separated August of 2006 she has also been living off savings. (I have the two older kids 50+% of the time and the 4 yr old 35%)

Now she is claiming that I must pay her 10k a month plus pay all her legal fees because she has stated that I have several business and that I am receiving income from those businesses) Since leaving I have tried unsuccessfully to start several businesses that she learned about from the kids.

Since we are both living from our community assets - savings (my bank statements will prove this) can she be successful in getting what she wants?

Thanks

How did you make a living prior to August 2006, and why did you stop doing that?

I was a partner in a small business and shut it down for health reasons and to please my wife with the hope of making life easier at home. Didn't work.

Prior to this I was lucky enough to benefit from the dot com days and had some stock that made some money. I split that money with her when we separated and I have been living off that until now.

Since I have 50% custody of two teenagers and trying to get 50% of the smaller one I can no longer do the business I previously engaged in. I've been attempting to get other projects off the ground without any success for the time being. Becoming a single father requires great effort. Since initiating the divorce I have chosen to invest in the future of my kids for the moment and wanted to ensure the transition was as smooth as could possibly be.
