Can I collect 1/2 of husbands retirement after 30 years of marriage and a divorce? What is the name of your state (only U.S. law)? Arizona Hi, My question is....After 4 children and 30 years of marriage, my husband and I got divorced 15 years ago. I just turned 62, my ex is 63 and still working. I have medical problems stemming from an accident. Can I collect 1/2 of his social security AND his retirement? I have NEVER remarried. He is remarried. Thank you, J.F. |

Help on SSA and retirement for divorced wife.HI, After 4 children and 30 years of marriage, my husband and I got divorced. This was 15 years ago. I just turned 62, he is 63. I have NEVER remarried, he has remarried. He is still working. I was told I could collect 1/2 of his retirement and 1/2 of his social security since I have never remarried. Is this true, and if it is how do I go about setting this into motion? If I ever remarry, does all of this income stop? And do I have to pay taxes on the income? Thank you, J.F. |

However you cannot collect any part of his pension or other retirement benefits, unless your divorce decree gave you the right to do so.

| And he cannot collect any portion of yours , unless the decree says so.
