yes-I have been on disability since 1990. memo of separation was signed by me, my ex, lawyer and notarized. date 8/2001.It was recorded in the courthouse , but as never seen by a judge.Divorce was granted 4/2003. Went thru mediation 12/13/08 for him not keeping up with support.Memo of judgement was signed by a judge for money owed 8/2007-8/2008 for 10,019 due on march 11, 2009.I paid 13,00. in lawyer's fees. I filed a claim for money owed again in 2/2009 for jan. and feb.$3500.00 to a magistrate. the memo of separatiom was never seen by a judge,and did not go thru family court. I am calling this a contract. Can I go before the magistrate for money owed, not district court? |

| You don't sue in civil court for a matter that originated in Family Court. If the ex spouse is not paying spousal support as ordered, you file for contempt in family court.

Ther was never a court. I have not been to court for anything concerning divorcethus, no family court. The separation agreement was signed by us and a lawyer. It was filed at the county courthouse, but never seen by a judge. The mediation agreement was signed the judge for money owed. That's it. The separation papers/divorce papers are , I would assume, a contract between us two. It was and is made not public knowlege. My ex is in breach of contract. What do you think now? You are a lawyer, right? |
