| | | Clause to end Alimony What is the name of your state? MD
Hope someone here can help - Written in a Separation Agreement/Divorce Decree is the following statement: " Alimony in the amount of $** will be paid to the wife indefinitely. The only terminating event of alimony shall be remarriage.". It goes on to state when the payments should be made, etc. There is NO indication in the paragraph of whose remarriage will change this agreement. Does this mean that the re-marriage of EITHER parties will terminate the payment of Alimony? Thanks for the help! |

| | | | BTW - she was the one who wrote up the original agreement (with the help of her attorney). Apparently this was an oversight on both their parts. |

| | | I have a feeling that if that is the EXACT language of the decree and there is nothing else to indicate that the "marriage" relates to the ex-wife (i.e., under the heading Jane Doe, the ex-wife shall retain the specific rights herein then he is being very serious. |

| | | | That is a direct quote from the "Alimony" section of the agreement/decree. Would there be any other specific wording somewhere else in the document that would override that statement? I cant seem to find anything else. |

There's undoubtedly nothing else, or you would have quoted it. Now go get married and end the alimony - - that is, of course, if marrying someone else, and putting up with their bullsh*t, is cheaper than paying alimony.
