Cohabitation Ignored?


What is the name of your state? Ohio

Boyfriend's lawyer told him last week that the last few cases he's brought up for re-evaluation for cohabitation were thrown out--and that Ohio doesn't do anything about it. How can this be? Why not just remove the law from the Ohio Revised Code and allow ex-spouses to support the new boyfriend/girlfriend. How can this be "equitable division"?


I GIVE UP!!!

Sorry--just ranting...

But does anyone know anything about this?

I am sure your boyfriend's lawyer told him that, does not mean it is the truth, or it may just so happened that some of the co-hab agreements did not meet muster. What I would do, is get the annotated version of that statute and review any case history which support its enforcement. If you cannot find it for your state then I would find another state which has the same "type" of laws and see how you can protect yourself. A Co-hab agreement is a contract, you have to make sure that the contract is followed, and all of the rules of a contract are followed. You might need to look at a little contract law as well.
