cohabitation or re-marriage not in contract

What is the name of your state? What is the name of your state? What is the name of your state?NH

My ex-husband and I were divorced in Jan 2004. He was order to pay me $150/month in alimony. He cheated on me a number of times during our marriage. Although I had all the proof I needed, I did not get nasty because he made a number of financial concessions (such as putting any equity from the house in trust for our 2 children). Of course, he now claims he never said this.

He has not paid me any alimony since June 2005. He claims he stopped because I remarried in July 2005. Our divorce decree states he is to pay me $150/month for 60 months with no mention of cohibitation or re-marriage. We went through mediation instead of hiring lawyers to keep things from getting nasty. However, on the day of hearing he showed up in court with a lawyer and tried to force me to sign a statement stating alimony would cese upon cohibitation or remarriage. I refused.

I have contacted a lawyer who states I have a 50/50 chance of winning. This just does not seem fair!

My response:

Thank you for your wonderful and exciting story.
