cohabitation in VaWhat is the name of your state? Va Does Virginia or Michigan recognize common law marriages? My divorce decree was finalized in Michigan but my ex lives in Va with a cohabitator. The ex has been receiving spousal support from me since the divorce. The cohabitator has been in the picture ever since the divorce (and before) and I am wondering if there would be any chance to have the spousal support terminated. The ex (she says) is medically disabled although she has been turned down for disability. I currently pay the mortgage on the house that she is living in which is due to be sold this coming May. The cohabitator, I imagine, has been helping her out as well. I have already been told to hire a PI but I would like to know what to expect from a PI (besides being paid) and, if I can pursue this, would the PI's accumulation of evidence of cohabitator's financial support of ex be accepted in court? Do we have a chance or am I opening up a whole new can of worms? |

| "Does Virginia or Michigan recognize common law marriages?" *** Only the following states recognize some form of 'common law' marriage: Alabama Colorado Georgia (if created before 1/1/97) Idaho (if created before 1/1/96) Iowa Kansas Montana New Hampshire (for inheritance purposes only) Ohio (if created before 10/10/91) Oklahoma Pennsylvania (if created before 9/03) Rhode Island South Carolina Texas Utah Washington, D.C. "I am wondering if there would be any chance to have the spousal support terminated." *** That would depend on the terms of the court order. If it says that it terminates only on re-marriage, you are still stuck. Before hiring a PI, you need to review the courts order to see what, if anything, would allow the termination of support. Simply, if there isn't anything, don't hire the PI.
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |
