Common Law

What is the name of your state? California

I had a live-in boyfriend for 7 years. We broke up. I moved on and is going to get married to another man next year. Now my ex-boyfriend wants me to pay the spousal support b/c he said we lived in together even though we never legally married. He's currently unemployed. Is it true that I have to pay spousal support?

My response:

Did your relationship begin and end in California, or did you folks start your relationship in another State? If started in another State, what is the name of that State?

No, we had always been in California. Another thing was that we did buy a house together but sold it.

MY RESPONSE: Okay, then you get the ultimate revenge by saying, "Listen up schmuck. You're about 125 years too late. California hasn't been a "Common Law" marriage State since the late 1800's. So, go sit on a stick and rotate! The only thing you're getting is Squat."

Another thing was that we did buy a house together but sold it.

MY RESPONSE: And your point is?

My point of the house is that ... I'm afraid he will say that we're connected financially.

My response:

. . . and I say, "So what?" People who cohabitate are usually "financially connected" in some manner or another; e.g., joint checking and savings accounts; are listed on the title to a car together; listed as co-owners of Real Estate - - it doesn't matter!

"Financial" connection to another person DOES NOT constitute a marriage, or allow any protections under the California Family Code.

I hope this alleviates your "fears".

My response:

Likewise, my dear, likewise.

Let me know the response he gives you after you tell him the "bad news".
