contract for support


What is the name of your state?Texas
Hi,
I have just found out that my husband was in the talking stages of an affair.
I love him but do not trust him and may not for a long time.
Anyway he swears that he will never do it again and that he will sign a contract through a lawyer that says he will pay me XXX dollars a month if he is caught cheating on me. Would this hold up in a court of law and would it be good for any state that he may live in? Also as it is not a court ordered contract, could it be worded so that it would not be considered alimony for tax purposes? Thanks for any advice

And what you are asking about is a post-nuptial agreement.
