CS & SS judgment


California law
What is the validity of child support and spousal support arrearages judgment if the judgment was never served? What kind of service it should be? both children are now 25 and 27 yo

My response:

It doesn't matter how old your children are today. Were you given notice of the contempt hearing? Did you appear?

No I was never served with any paper (the gudgment is from 8/97) until DCSS send me a letter in 11/04.

Obviously, you moved away in 1997, or before. Therefore, no personal service was necessary. You were served by Publication.

You owe the money.

Is that applied even that my address was known to the court and to my Ex?

My response:

It doesn't matter what your wife knew or didn't know. She wasn't handling the case; DCSS was handling the case, and they're the ones who didn't know where you were located. The court? Why would the court care if you moved or not? Pal, the fact remains, you're a deadbeat. You didn't pay what the court ordered you to pay. You're in Contempt of Court, and you're on the hook for the principle amount, plus accruing interest.

You're damn lucky they haven't come to where you live with the Sheriff, and have you arrested and incarcerated for your Contempt of Court. Consider yourself lucky - - at least so far.
