custody supportWhat is the name of your state? oregon i recieved an unfavorable response to my last question maybe because of not enough info. my 16 yr old daughter who i pay support for has been kicked out of the house by her father. he is still taking my support. the court said i had to get a lawyer to get the order modified but had to proof she was living w/me because shes a minor or get him to sign a release for support. i see niether happening as she is living with a boyfriend and her father would just as soon keep her money. obviously i can't afford lawyer fees. is there any other way? am i stuck paying him support for two more years because shes not living with either of us? |

Just curiousHave you checked into the emancipation laws? I really don't know anything about them but it would seem that if neither parent has her and she is living with a boyfriend than that may be grounds for this???? Don't know but maybe someone else can help with this. I would do research and contact lawyers for free consultations (they do have them) and ask them. It never hurts to research.

| You do not have to get a lawyer. Although I would suggest it if you can afford it, and I also agree that you should call a lawyer for a free consultation. Most likely all you will have to do is go to the courthouse and get a Modification for Child Support form and file it. They will tell you what other forms need to be filed along with it. If she does not live with him, HE is not entitled to support payments. |

| Not true. He still has legal custody of the child. Unless she can support herself without anyone elses help, you still have to pay. Or, if you can get custody modified and have her live with you, then the tables will turn. Until then, you pay.
