dad denied vists

My brother just got out of Jail he and his wife are still married but are trying to get divorce. He was served with the papers in jail, she is asking for full custody and he was to get out in a few months and sent a letter a to her lawyer saying that he wanted shared custody when he got out. The day after he got out me and our mother went to see if we could get the baby. She is 2 1/2. She got hateful and said no we could not see her and he definatly could not see her until "her" divorce papers were signed. I just want to know is he allow to see the baby before the divorce and what chances does he have getting shared custody.

WHAT STATE ARE YOU IN?

Well, first of all, she doesn't have to let YOU and your MOM see the child EVER.

Secondly, she doesn't have to let HIM see the child until a court orders her to.

Thirdly, what was he in jail FOR?

OH... and you really should move this thread to the appropriate forum.

3RD OF ALL - IT IS NONE OF YOUR BUSINESS WHAT HE WAS IN JAIL FOR THAT IS NOT THE ISSUE HERE IT IS ABOUT A FATHER NOT GETTING TO SEE HIS LITTLE GIRL

OH...... IS THIS NOT THE FORUM ABOUT CHILD CUSTODY AND ISSUES LIKE THAT IT HAS AS MUCH RIGHT ON THE PAGE THAT YOU DO LEAVING THIS RUDE COMMENT

WILL SOMEONE THAT KNOWS WHAT THEY ARE TALKING ABOUT LEAVE A COMMENT

So why wasn't your brother with you? Did you honestly think that mom was just going to hand the child over to you? I bet that she wasn't the only one that was "hateful". Did you call and try to make plans with her in advance?

He went to prison...that can be a problem in child custody issues. If you don't recognize that, then you are not riding the reality train.

If you want valid legal advice it IS our business, because what he went to jail for MATTERS. If it was a non violent crime then his position is much stronger than if it was a violent one.....and ALL KINDS of combinations of other factors.

Actually, its really kind of wierd to post a custody/visitation question on an alimony forum.

wow, I'm shocked the mother was "hateful" to you when this is how you act to complete strangers who are trying to help you.
