debt responsibility during separation


What is the name of your state? georgia
who is responsible?

a couple has been living apart, separated but through no legal form, for 6 months. the husband has maintained health insurance through his employer on his entire family, his estranged wife included. their 2 children are left in his care. the wife admits herself into a hospital for drug/alcohol abuse. the husband is unaware this, was not notified by the hospital or his estanged wife. months later the husband receives bills for the hospital visit, then collection letters and finally an intent to sue by the hospital. is the husband responsible for the financial debt even though he signed no documents accepting responsibility? remember, he did have medical insurance on his estanged wife but they had not be living together for 6 months. i have read that in most states, debt incurred during separation is the responsibility of the spouse incurring the debt unless debt is for the benefit of a minor child. is that the case in Georgia? what is the precedent? please advise.

Yes he is responsible for the bills, but he does have insurance so he should submit the bills to the insurance company and , then pay off the difference of the balance due.

If they were legally separated, the wifey would be responsible for her bills.
