Divorce and Alimony ?

What is the name of your state (only U.S. law)? Alabama

My enstranged husband and I were married May 2007 in Tennessee, and separated in October 2007. He committed bigamy in either 2008 or 2009 (trying to verify this information now). I just found out from his ex-girlfriend that he wants to stay married to me as long as possible, so he can get alimony. Right now, he is located in Oregon in their county jail. I would like to know how to proceed with this. I want to file myself, but at the same time, if he is going to request alimony, I might need to obtain a lawyer. Any information or advice will be greatly appreciated. ETA: We do not have any children or property together.

What makes anyone think he is even entitled to alimony? You weren't even together six months.:eek:

I doubt very seriously that an Alabama judge is going to award him any alimony. :cool:

Where complaint to be filed.

Complaints for divorce may be filed in the circuit court of the county in which the defendant resides, or in the circuit court of the county in which the parties resided when the separation occurred, or if the defendant is a nonresident, then in the circuit court of the county in which the other party to the marriage resides.

Have you continued to support him since the separation?

He should be easy to serve at this point. I'd get the case filed and get service at least. If he responds and you're not comfortable going forward on your own, you can consider a lawyer or seek other assistance at that time.

Never supported him. He was in the military and was required to send me an allotment before he got out, but once he got out, I never heard from him, and found out he had married again through a mutual friend.

I am in the process of getting the papers together now. I am going to attempt to file on my own, but I see he will need to have the papers notarized, how will that be possible since he is in the county jail?

You only need his signature if you are going to attempt an uncontested divorce. If he thinks he is going to get alimony, or at least try for it, its not going to be uncontested.
