Employee perks


What is the name of your state? California

Are employee incentive percs such as a car allowance included in the income amount used to calculate support or are they disallowed like taxes, etc.?

My response:

Employment "perks", as you call them, are considered "bonuses" for purposes of child support calculations. Like cash bonuses, those "perks" have a value which adds to the overall income of the employee. In other words, "but for" the bonus (or "perk") the employee would necessarily be required to go out and purchase an automobile. But, because of the "perk" or "bonus", that is not required. So, the value of the car is calculated into the equation.

IAAL, I do not pay CS, but as one who does get such a "perk", I'm curious how the adjustment is calculated for the actual business use of the "perk"? I mean, I get an allowance for a car BECAUSE my job has me running all over and putting many business miles (about 20,000 yr) on my car that a "stay in the office job" does not. MY job duties cannot be performed without a personal vehicle, as my customers and county courthouses are in five different counties.

In other words, if I weren't doing what I do, I would not have need of the allowance, and the allowance is Reimbursement for utilizing my own car for company business. It would be inappropriate to pay child support on money that is payback to me for using my car constantly on company business.

Does the CS system honestly believe that we who get an auto allowance just have that money to pocket and that we are not actually recieving it because we need it to cover our business auto use?
