Ex cohabitates with fiancee 75% of time


He only takes the kids to stay at his house during custody - the rest of the time he lives with her. He does not work - she does. Can I get my support payments reduced?What is the name of your state (only U.S. law)? CAWhat is the name of your state (only U.S. law)?

What proof do you have that he lives with her? Where does he receive mail? Where are his belongings? Where is he registered to vote? What address is on his driver's license?

Ex cohabitates with fiancee 75% of time


My ex, who claims permanent disabilitiy, has been turned down for SSI twice and has hired an attorney to try once more. He has not taken advantage of any retraining offered by WC insurance. He refuses to seek work saying he is disabled. I pay $1000/month support. He has told me he living with her - except for when our girls visit him every other weekend and when he has them for other time off from school (total approx 25% of time) since fiancee's house is "too small". I am guessing he still gets his mail at his old house, since he rents it to his son. He has left his furniture there for the son. Personal items (clothing) have been moved out. Is there a way I can get support reduced? What would be considered proof that he is cohabitating? Thanks

Even if you could there is one aspect which might preclude you from modifying downwards anyway - your ex's disability. It wouldn't be much of a surprise if you have to wait until the current disability application is decided. Being turned down twice does not mean that he's not disabled - many SSI attorneys won't start representing you until you've had at least the first denial. And most SSI attorneys won't even touch the case unless there's a relatively high likelihood of it being approved at the ALJ appeal.

Other than that you'd have to have proof such as mail going to that address, driver's license showing the change of address, that sort of thing. Without that you have a very tough battle ahead of you if you decided to file for a modification.
