My husband's divorce was finalized in Sept 1997. He has a QDRO order for his pension with Florida Retirement System. The QDRO states the ex is entitled to 50% of his penion benefits accrued up to Oct 1997. He has been paying alimony to her and according to the QDRO that is to stop when he retires and then she gets her $484.55 from the plan administrator. My question is can the ex fight to get more money since he makes more money now than when he did when they were married? She thinks she is entitled to 50% of all his pension benefit but I don't think so. The QDRO specifically states she is to get 50% up to Oct 97 and also specifies $484.55 per month when he retires. Child is grown and support for her stopped years ago. Thanks for your help. |
You need to post the EXACT wording of the order so that we can help.
The way you have explained it, it sounds like ex gets 50% of pension accrued to Oct '97 AND an additional $484.55 per month alimony.
