| good advice vs. bad advice Calif. I am in the final stages of a divorce (marital settlement agreement). My attorney tells me that spousal support is a given based upon local county law. My wife has always worked and quit to get more money. I have no issue with child support, but am adamant against the $750 per month spousal support and attorney fees $6000 she spent. I think she has an obligation to work or have a judge impute her earnable wage, and she is responsible for $6000 she spent from sale of home. My attorney says to pay both or just wait for her to move on then we settle. He threatens if we go to trial that I will lose, so wait or pay. I need good advice as to fight or roll over. I want to fight the attorney fees and spousal support issue. She has always worked and makes about $15 per hour. Her attorney has been bought and paid for. I told my attorney I will settle for $1100 per month(CS and SS combined) and no attorney fees. (marriage was 7 years) He says I am stubborn and won't listen to his advice. Lots of other factors involved re: her falsifying info, etc. Bottom line is spousal support, as a rule, always given in accordance to dissomaster, and are attorney fees always awarded to spouse making less money? Income: $86K me, 31K wife, 50-50 custody, 1-week each parent. |
