How do I keep everything I worked so hard for.


What is the name of your state? NY

Here is my short story. I am about to take my husband to court for Child Support ( which I really do not want to but i have no choice). Presently, we live together but separate lives. I work two jobs and my husband stays with the baby after work. My problem is on the weekends he gives me a hard time because he wants to have his weekends for himself and he disappears, when i have to go to work. Naturally i have to pay someone to baby sit and he refuses to help because he thinks i don't need to work two jobs. (We already pay child care for during the week ).

So my question is,

1. When i take him to court and he gets the summons for CS & SP i know he will move out and i will be the one to handle all the bills in the home ( which is very high). Can i ask the judge to let him continue to pay his half of the bills in the home**************..Even thou i am way more financially stable than he is? He makes about 55k and does not have a penny in savings.

2. Will the judge look at my financials and determine that i do not need CS & SP?

Can someone answer these questions for me so i can know what to do?

You can't file for CS for someone that currently lives with you.

Yes, you can request that he be ordered to help with bills. Whether or not your request is granted is up to the judge and some other factors.

I don't know whether or not a judge will think you need SS. IF you have the children, you WILL get CS. Depends upon the end arrangement.

Time for you to read up on some NY divorce law. It's available on this site, or you could google.
