My wife left and I filed for divorce 4 months before our youngest granduated. I paid the four months of child support and the judge awarded temporary spousal maintenance of $500/mo. although she was asking for $1200. We are now several months into a battle over spousal maintenance. Over the last 10 years she has been in and out of jobs, working roughly 75% of the time, she has not worked since she left and I filed for divorce, that is 10 months now. My question: Based on her work history... if I can prove she is fully capable of working, and simply chooses not to, in order to support her case for alimony... is imputed income a given, or is it difficult to get the court to acknowledge?
